These Terms of Service govern your use of the Garden Organix website and your purchase of products from Garden Organix. By accessing the website, placing an order, or using a Garden Organix product, you agree to these Terms.

Eligibility

You must be at least 18 years old, or the age of legal majority where you live if higher, to place an order. Products are sold by the case, but purchasers are not required to be verified businesses or resellers.

Orders and acceptance

Submitting an order is an offer to purchase. Garden Organix may accept, reject, limit, or cancel an order for reasons including product availability, suspected fraud, pricing or listing errors, payment issues, shipping restrictions, or misuse of the website. If a paid order is canceled, the applicable payment will be refunded.

Pricing and payment

Prices, product availability, promotions, and shipping charges may change without notice. The price shown when an order is submitted controls, subject to correction of obvious errors. Customers are responsible for applicable taxes and charges shown at checkout.

Order changes and cancellations

Orders may be changed or canceled only before shipment. Once shipped, an order cannot be changed or canceled and is governed by the Return and Refund Policy.

Product information

We make reasonable efforts to present product descriptions, colors, images, quantities, and other information accurately. Screen settings, natural ingredients, production variations, mixing, application, and environmental conditions can cause actual appearance or results to vary.

Product use and results disclaimer

Garden Organix products must be mixed, applied, stored, and used only as directed on the product label and accompanying instructions. The purchaser and user are responsible for determining whether a product is appropriate for the intended tree, plant, environment, surface, and application conditions.

Because application methods, weather, tree condition, surface preparation, mixing ratios, and other circumstances are outside Garden Organix's control, individual results may vary. To the fullest extent permitted by applicable law, Garden Organix is not responsible for damage or adverse effects resulting from misuse, improper mixing or application, failure to follow instructions, use for an unintended purpose, or conditions outside our reasonable control.

Nothing in these Terms excludes or limits liability or any consumer right that cannot legally be excluded or limited.

Prohibited uses

You may not use the website for unlawful, fraudulent, abusive, infringing, or harmful activity; interfere with website security or operation; introduce malicious code; scrape or copy website content through automated means without permission; impersonate another person; or submit false information.

Intellectual property

The website's branding, product names, text, graphics, photographs, designs, and other content are owned by or licensed to Garden Organix and are protected by applicable intellectual-property laws. No rights are granted except the limited right to use the website for lawful shopping and informational purposes.

All website content, including text, photographs, graphics, product descriptions, logos, and other materials, is protected by United States copyright and other intellectual property laws and may not be copied, reproduced, or distributed without prior written permission from Garden Organix.

Third-party services

The website may use or link to third-party services, including Shopify, payment processors, analytics providers, and shipping carriers. Their services may be governed by separate terms and privacy practices. Garden Organix is not responsible for third-party websites or services outside our control.

Disclaimer of warranties

Except for any express written warranty and to the fullest extent permitted by law, the website and products are provided without additional warranties, express or implied. This clause does not exclude warranties or remedies that cannot legally be excluded.

Limitation of liability

To the fullest extent permitted by law, Garden Organix will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or products. Any limitation applies only to the extent legally enforceable and does not apply where liability cannot be limited by law.

Indemnification

To the extent permitted by law, you agree to indemnify and hold Garden Organix harmless from third-party claims arising from your unlawful use of the website, violation of these Terms, or misuse of a product. This provision does not apply to claims caused by Garden Organix's own conduct to the extent prohibited by law.

Governing law and venue

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. To the extent a dispute may lawfully be required to proceed in a particular venue, the parties consent to the state and federal courts with jurisdiction in Pinal County, Arizona. Nothing in this section deprives a consumer of protections or venue rights that cannot legally be waived.

Severability

If any provision is held invalid or unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law.

Changes to these Terms

Garden Organix may revise these Terms from time to time. Updated Terms become effective when posted, unless a later date is stated.
